1. Introduction

These Terms and Conditions ("Terms") govern your use of the AI Trades Pilot website and services, provided by THEAIQS LTD ("we", "us", "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Definitions

• "Service" means the AI Trades Pilot platform, website, apps and related features.
• "You" means the individual or business using the Service.
• "Content" means data, drawings, documents and information you upload or generate.
• "AI QS" means our AI quantity surveying feature that produces priced Bills of Quantities.

3. Your account

You must provide accurate information when creating an account and keep your login details secure. You are responsible for all activity under your account. You must be at least 18 and authorised to act for the business you represent.

4. Subscriptions and billing

The Service is offered on two subscription plans (Sales & Marketing, and Unlimited), billed per company on a monthly or annual basis. Subscriptions renew automatically until cancelled. Prices are as shown on our website and may change on notice; changes will not affect your current billing period. You can cancel at any time, effective at the end of your current billing period. Except where required by law, fees already paid are non-refundable.

5. AI QS credits and add-ons

AI quantity surveying take-offs are billed separately from the subscription, per job, at the prices shown on our website, with any applicable tier discount applied. Optional add-ons — such as the work phone number and AI note-taker — are billed as described at sign-up, including any usage-based charges. Add-on availability and metered allowances are as stated on the pricing page.

6. Free trial

We may offer a free trial (currently seven days) and/or a free introductory AI QS job. We reserve the right to determine eligibility and to modify or withdraw trial offers. Unless you cancel before the trial ends, your subscription may continue on a paid basis at the applicable rate.

7. Acceptable use

You agree not to:

• Use the Service unlawfully or for any fraudulent or harmful purpose.
• Upload content you do not have the right to use, or that infringes others' rights.
• Attempt to copy, reverse-engineer, resell or white-label the Service except as expressly permitted by your plan.
• Interfere with or compromise the security or integrity of the Service.

8. Intellectual property

The Service, including its software, design, branding and underlying models, is owned by THEAIQS LTD and protected by law. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your business while your subscription is active. Where your plan includes white-labelling, that use is limited to the scope set out in your plan.

9. Your content

You retain ownership of the Content you upload. You grant us a licence to host, process and use that Content to provide and improve the Service, including to generate your outputs. We handle personal data in line with our Privacy Policy. You are responsible for ensuring you have the right to upload your Content and any third-party information it contains.

10. AI outputs and professional reliance

The Service uses artificial intelligence to generate priced Bills of Quantities, documents, schedules and other outputs. While we work to make these accurate and useful, they are provided as tools to assist you, not as a substitute for your own professional judgement. You are responsible for reviewing and verifying all outputs — including pricing, quantities, method statements and contract terms — before relying on them or sharing them with clients. We do not guarantee that any output is complete, error-free or fit for a specific purpose, and we are not liable for decisions you make based on them.

11. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may carry out maintenance, updates or changes, and may modify or discontinue features from time to time. Where we offer a same-day AI QS turnaround, this applies to jobs submitted within stated cut-off times and subject to reasonable use; any specific service guarantee is as stated on our website at the time.

12. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that:

• We provide the Service "as is" and exclude all implied warranties to the fullest extent permitted by law.
• We are not liable for indirect or consequential loss, or for loss of profit, revenue, contracts, goodwill or data.
• Our total liability to you in any 12-month period is limited to the amount you paid us for the Service in that period.

Because you are using the Service for business purposes, certain consumer protections do not apply.

13. Suspension and termination

You may cancel at any time as described above. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; we will make your data available for a reasonable period where practicable, after which it may be deleted in line with our Privacy Policy.

14. Governing law

These Terms are governed by the laws of Scotland/England & Wales [confirm which], and the courts of the United Kingdom will have jurisdiction over any dispute.
